Japanese mothers have an unfair advantage in that Japanese legal system doesn't recognize a foreigner's right to see their kids. It's basically a sanctuary for child abduction. For every sad story of a Japanese mother who can't see her kids, there are at least 100 stories of the foreign parent not being allowed to see their kids even when they win custody in their home country.

Japan said they would sign this back in early 2011, but they're still dicking-around and back peddling and going back on their word. They're doing anything to delay signing the Hague Convention, even though they're the only country in the G8 not to sign. There's something wrong in that. Japan wants to have its cake and eat it.

"Divorce is not very common here" It *is* common. 1 in 3 marriages ends up in a divorce in Japan.

Very Happy the Hague Convention was finally signed. Hopefully many other progressions will be made. I know a few heartbroken Dads who need to find/meet their "lost" kids in Japan.

Japan is a black hole and haven of child abduction. Signing the Hague treaty will not change this. Japan kidnaps children and forces termination of parental rights on children of divorced parents. There are approximately 2.5 million children in Japan today who have no meaningful access to one of their parents. A parent who attempts to see, much less raise, his child is subject to arrest and imprisonment. 4000 U.S. minors are today permanently deprived of their parent by the Japanese state.

Japan's post-divorce "sole physical custody" law is an evil & massive human rights violation. Japan should be castigated & punished until the stolen children return to their parents.Persons who have knowingly kidnapped children & brought them into Japan from abroad seeking a safe haven should be arrested, deported or extradited, & charged.Countries and families from which they stole children deserve the right to decide how these criminals are to be held responsible. Not Japan's courts.

The Japanese return law presumes that the kidnapping of the child is not harmful; only concerns about the return - ie. the mother is a criminal & kidnapper so she might be arrested - are to be considered by Japanese court. Professor Tanase explains- if mother has few friends, no relatives in the country of permanent residence, or a language gap, Japanese courts can refuse return of the child to his/ her parent. So,why is Japan signing the Hague under laws that obliterate its purpose?
