about a 12 year old girl taking up the dispachters time that could have
been used to actually attend to emergencies. If anything this woman should

drawn, problably. They thought they were approaching who knows who and
according to Mr. numbn*** on the radio, they'd already been confrontational
with the 1st. gentleman. which never happened !! It's happening from
Salem,Mass to San Deigo, Cal. these people have absolutely "nill" training
when it comes to interpersonal contacts with the public. So, in my humble

I just want to point out that the courts have ruled that an investigative
detainment, which must be brief in nature, is legal. And the the dispatcher
did (wrongly) accuse you of things.

Walking in an area where one has the right to be and engaging in lawful activities isn't grounds for reasonable suspicion, which is a term of art meaning articulable facts which would lead a reasonable observer to conclude they are seeing a crime happening or about to happen (Terry v. Ohio). By the officer's own words nothing he heard amounted to reasonable suspicion. Being concerned or suspicious isn't sufficient to produce reasonable suspicion.The bulk of the fault here does lie on the dispatcher, but even with his lies nothing he told them amounted to a description of (possible) criminal activity.
The question is, how do we keep from this happening again? What is our
recourse after being harassed and intimidated? What happens to the
dispatcher who made false assumptions which caused the police to act in a
manner that was unnecessary?

Provided you're charged with a criminal defense you can demand a jury trial regardless of whether or not you are citizen. You can demand one whether or not you provide a "certified record of birth" or any other document.

+bacchys most jurisdictions actually do require their officers to have a surety bond. While its not a legal requirement as a base for employment as a peace officer, many cities and states do require it. Peace Officer's Surety Bonds are a very real way of seeking remedy for violations of rights.The catch is, its technically not LEGAL (or in this case criminal) remedy, only a matter of contract law, much in the same way that if i cause an accident, the other injured party can make claims against my insurance company far more easily than trying to press for charges against me or filing suit in civil court.
+bacchysI remember reading an article about that. Many people have recommended that cops be insured and any claims against that cop could force an insurer not to insure that cop. That would get many bad cops off the street. Interesting idea.
+Trenton Stone You should read up on qualified immunity and the difficulty in overcoming that in holding a police officer personally liable for his actions. Your "bond number" claim is useless. +ElGatoLoco698 You can sue in Federal court for a violation of your Fourth Amendment rights against unreasonable search and seizure. If the dispatcher isn't a law enforcement official, he may not have qualified immunity, which means you can sue him directly. Win or lose, in that case, it will cost him money. That might deter future dispatchers from embellishing.Sadly, there's really nothing you can do to stop the cops from unlawfully detaining people in the future. They are protected by qualified immunity and the courts have said they can be mistaken on the law and the facts and they're still protected. Only if you can prove they intentionally violated your rights and were motivated by personal malice could you sue them directly. At best, you have a civil suit against the department, and that's not going to deter any individual officers from unlawful acts.
