+Matt Hoyte Give it up.  Those witnesses were determined to be lying under the Obama department's report.  The only witnesses who's testimony didn't crumble under testimony were those that supported Officer Wilson's account of Brown attacking him.  All of the evidence points to the fact that Mike Brown was attacking officer wilson when he was shot.  How do you explain the black eyewitnesses who are on the Officer's side?  What motivation could they possibly have to lie.  Not to mention the forensics completely debunk your side.  You literally have no argument. "But of course who cares about systemic racism when we can focus on the position of someone's hands."Complete red herring.We were talking about the Mike Brown case specifically and you broadened it out to the department as a whole because you know you're wrong on this issue.  The facts are not on your side.  Mike Brown was attacking officer Wilson.  He was not the "gentle giant" that the media and people like you painted him to be.    

+The Moral Crusader The forensic evidence does not show what position his hands were in when he was shot...or before he was shot.  and credible witnesses say that he had his hands up for a brief moment before he charged the officer.  This is all a fundamental misunderstanding of the burden of proof.  But it's a fairly trivial detail.  the bigger point missed by focusing on the position of his hands was the finding that "The Justice Department did not find grounds to charge Wilson, but did find evidence of systematic racial discrimination in Ferguson at the hands of the city's police department and municipal court."But of course who cares about systemic racism when we can focus on the position of someone's hands.

Did you see the shooting a few weeks later?  The guy with the knife who stole a can of pop?  they knew he had a knife and wanted death by police....so they calmly walked up and shot him...there's video.  the police were justified because he had a knife and threatened them....but they also seemed to have no plan but to shoot him.  And the 12 year old with the pellet gun...same thing.  no tactics but shoot.I've heard from police that I know that it is almost impossible to take an officers gun from the holster.  It has a safety clip for just that reason.  Also, shooting an unarmed man just seems unjust on the face of it.  I dunno, there is still stuff that just doesn't seem to add up about this.  The shooting itself is one thing, but there are strange things surrounding it too. Anyway, I don;t think we're on different pages really.

+Neil F _"What is true is that the reasons the public thought the police officer was a racist murderer have been proven to be fabrications."_- Not exactly.  There are many issues that have come to light surrounding this that give people pause.  Granted it's not just a race issue, it's more a police use of force issue.  Wilson and many on that force refuse to use non lethal force, it is a fact that he was unarmed.  If this happened in any other developed country he most likely wouldn't have been killed.  Get this, in other countries they actually train police how to descalate confrontations and subdue people without lethal force.  The complete lack of diversity on the force.  Approx 95% white police in a %95 black community.  And others.  If this was an isolated incident it would be an issue.  But there have been many much worse incidents before and since.  

+Neil F I looked at the autopsy report...the actual evidence.  What makes a witness credible?  As I said there is only ONE person who witnessed the entire thing...and NO eye witness testimony is completely reliable.The forensic evidence is inconclusive.  He wasn't shot in the back...but he very well could have been shot from behind or with his hands up.  Again, I'm not being ambiguous at all....just nuanced.  From the DOJ report:"Therefore, the autopsy resultsdo not indicate whether Brown was facing Wilson or had his back to him. They do not indicatewhether Brown sustained those two arm wounds while his hands were up, down, or by hiswaistband. "So all claims that the DOJ report PROVES that he didn't have his hands up are false.  They cannot prove it either way and that's why they can't press charges.  But I see what you mean about the eye witness reports...there are more then I realized.  But there is still more to the story.  I think were not on that different pages on these specifics.

+Neil F Are you aware of how many false convictions are due to eye witness testimony?  %100.  Eye witness testimony is one of the least reliable types of evidence.  there is only one person who witness the entire altercation...and he is considered unreliable.But that is somewhat beside the point.  In this case it is not clear at all.  that is why they didn't press charges.  Justified/not justified is the same a guilty/ not guilty.  Nothing 'proves' that he was justified....it's just that there is no concrete evidence that he wasn't justified.I deal with the anatomy of movement for a living.  The autopsy shows one of the shots went though the inside of his forearm.  The only way that can happen is if they are facing away for the source of the shot or have their for arms raised above their elbow.The crime scene was also not secured properly and evidence was handled improperly.  I agree that none of that is enough is to convict him of anything.  But that along with a whole lot of other circumstantial evidence is extremely fishy if you ask me.  If anything it points to a whole lot of callousness, bigotry and a good old boys club.  No of which is illegal in itself....but is also nothing to be proud of.

+Neil F I read the relevant parts.  Doesn't change what I said above.  There is an important technical difference between being 'not guilty' and being 'innocent'.

+Fenny Famous How did the trail of blood show that he ran?  And in order for their to be a trial of blood he must have been shot before he turned around.  I don;t have blinders on...I just know how the justice system actually works.  Nobody is ever proven innocent....just not guilty.  And the difference is important to understand.  Just because you can't prove guilt does not mean you've proven innocence.
