passes a law they don't like, such as sodomy laws, but when it comes to a
state passing a law legalizing marijuana, suddenly they're in favor of
state's rights.
Quite true, everyone likes to cherry pick their laws, and their interpretations. However, very few conservatives are crying "States Rights!" in the issue of marijuana legislative reform (especially in a public forum), but when abortion and other religiously inspired legislation is the topic of contention, suddenly the conservative mindset is that States reign supreme.The big difference:Any argument for states rights that LIMITS the rights of the people is not a valid argument for states rights. That is an argument for big government and legislation of personal morality; typically a case for religious THEOCRATIC control. So if you say no to someone committing the act of sodomy, you are placing your morality in a theocratic manner upon other people no different than the Muslim nations to whom we cry "foul". That cry in favor of "States Rights" is hypocritical, because it isn't the "right" but more so the "right to deny rights".That is the difference between the supposed "liberal" and "conservative" cherry picking of the 10th Amendment.

We have freedom of religion in this country. It's promised in the constitution. In all seriousness though we're talking about trying to tell people how they should have sex vs the regulation of a controlled substance, the former of which is clearly outside government jurisdiction and the latter is debatable whether it is federal or state jurisdiction hence the controversy.
Anti-sodomy laws and anti-marijuana laws have something in common; they violate your right to decide for yourself what you want to take into your body. ;)
