Wal Mart follows State Laws MMMKAY. These officers are jackasses MMMKAY.
They got A call from the offduty sheriff in the parkinglot MMMKAY. These
officers obviously were not taught about 13A-11-52 or 13A-11-73 MMMKAY.
There is no sometimes when it comes to having a right and having that right
infringed MMMKAY. Concealed Carry Permits ALLOW concealment and carrying in
a car. MMMKAY. It DOES NOT limit you to concealing and car carrying.
MMMKAY. Carrying Concealed is more dangerous to the public.
After listening to the cops tell the person open carrying his firearm that
it is legal to do so, then asking him " Don't you think this would cause
alarm?", makes me ask the question instead of chastising a person that is
in compliance with the law, why not educate the person that called them in
the first place and inform them of said law as a service to the public.
Bullying a law abiding citizen in order to allay fear, instead of upholding
the constitution, only undermines the constitution.
Private property owners can prohibit firearms. SB286 was signed into law
and goes into effect next week: Section 6. (a) A person who owns or
controls property that is open to the public may restrict or prohibit as
trespassers those who possess or carry a pistol, including those persons
with a license issued or recognized under 10 Section 13A-11-75, Code of
Alabama 1975, while on the property provided that notice of the prohibition
is prominently posted at any public entrance to the property.
so why do so many people argue about this. What I heard if it causes a
problem/alarm/concern or what ever of any sort...a business can ask you to
leave.Am I wrong? I'm all for our rights and carrying (I'm in MI) although
I don't understand open carry. guns are made for killing. The majority of
the population, I believe, is uncomfortable with such items because of
that. Anyway, I couldn't hear. All these videos about this issue shows
confrontation & like smart-talking back to officers/others
Is Auburn PD proud of these idiots that pass for officers? Hiring standards
need to be implemented to weed out the idiots. Federal lawsuits are filed
for 4 A violations like this all the time. Your not being detained and your
not under arrest! What? Is this Auburn PD's version of not being detained?
The Cheif of police must be proud of these officers. I see more training in
their future. They should be charged with coersion under color of law for
trying to make the manager trespass an LAC.
The LEOs are tools...did zero good to talk with them...I highly suggest
that you find a lawyer and partner with him to sue that crap out of the
city for violating your rights... This is obvious harassment when they have
to go find the Wal-mart manager and intimidate him to ask you to leave. The
obviously detained and searched you illegally and this type of poor LEO
behavior will continue to happen if citizens do not leverage the courts to

I feel safer with citizens having guns than cops, at least the citizens do
not act like complete assholes everytime you speak to them. Ever ask one of
these asshole's (Cops) how to get somewhere? They act like you have no
right to even be on this planet with them, much less the human right to
talk to them. There all Spoiled ass people that think there above everyone
else. I don't like them, I don't want them around me, and can see no use
for them. "Let a man protect you and he OWN'S you."
Here is some advice.... When these redneck idiots started telling you shit
like "You think your smart ... Shut your mouth dont tell me the law" ....

An important clarification. Your right to carry a firearm ENDS at the
boundary of any private property right owner who says it does. Period.
Wal-Mart has no national policy on carrying of firearms into stores. They
can and do allow it in most places. In others, customers have been asked
not to bring guns into stores in the future if other customers complained.
I know of one store that briefly had a local "No firearms" policy, but
later rescinded it.
If he wasn't being detained and he wasn't being arrested then he was
illegal held against his will possibly a good argument for kidnapping,
assaulted and deprived of his property which is theft the moment the gun
leaves his hands unwillfully, so much this man has to work with including
harrasment & profiling, this is a attorneys/lawyers idea of a wet dream
with all the victoria secrets calendar girls, if he/she was to get their
hands on this case.
Only a ass would reply " Walmarts policy is that firearms are not allowed
on their property " when they dont even know what Wal-marts policy is?
Walmart follows state laws and if there is a sign posted on their front
door with a picture of a gun with a circle around it with a line through
it, then it isnt allowed. I have never been to a Wal-mart with that sign on
any of the doors. So get your facts straight before they exit your fingers.
Wall-mart needs to request him to leave first than it would be considered
trespassing. You cant just call the police and have the police threaten him
with disorderly conduct. When I open carry and someone calls the police I
ask if they requested me to leave first. If the police say that the person
requested me to leave than I walk away and say that I am not committing any
crime because I am not trespassing after leaving upon request.
This guy doesn't know how to handle cops very well. He allowed them to
bully him and illegally seize his property, all while not being detained
according to the contradictory cop. BTW, Walmart allows open carry in
states where it's legal. This could have gone much smoother had the guy
known how to protect himself. If it still goes bad, 2 bully cops lose their
jobs and you win a nice lawsuit against the city.
Stood his ground?... you mean trespass? If a store manager/owner asks you
to leave the property you MUST leave. Its their right to kick you out and
in most states they dont even need a reason to. As someone with a CCW, I
don't shop in stores that state no firearms for 2 reasons - 1. By law I
have to follow their wishes on their property. 2 I wont spend my money at a
place that doesn't allow legal firearms.
This is nearly a copy and paste of St. John v. McColley, et al., where the
city was sued for unlawfully seizing someone's firearm. A Federal judge
rules police cannot detain people for openly carrying guns and he was
awarded $21,000 as a result. Here is a quote from the judge "Leave open
carriers alone unless you have "reason to believe that a crime [is] afoot."

either relieves him of his position or orders him to rescinded his initial
claim that the customer must conceal or leave - his initial requests stand.
My only point is that a written policy can not override a managers verbal
requests, it can however result in him being fired, which he should have
been.
I shure hope this guy got him a attorney and went to the auburn police
dept. and brought this matter up to there chief and mayor cause I think
there confused as to what open carry really means. hmm ok they even state
your not breaking any laws or being detained then proceed to tell him he is
being interview which is clearly being detained. these cops are confused.
Now here is the ultimate catch 22. You can legaly open carry, but an off
duty officer recommended comiting a FELONY? ( to save harasment?). I.E.
only law abideing citizens follow the law yet the criminal could care less
about a phrase in a book. So should you risk the headache and open cary or
the Felony and cover it up? I fight with it every day in N.C.

and say that he is not following state law, which is the truth. Walmart
Corp will override what that manager does, and either he/she will change
their tune, or there will be a new comanager becoming the manager... Ive
seen it happen before.

More cops who operate outside the law. The officer should be disciplined
for telling him to to shut up. Also they had zero cause for a warrant
check. He could have refused it and asked if he was being detained and they
would have had to let him go.
This has my blood boiling! Takes me back to a few of my first encounters
with police here in Missouri. Disrespect, duress, and threats If you have

would've been a scrap right there in Wal*Mart because that would've made me
feel threatened.
