Fix the public records at the felon's expense prior to Clemency. Felons
sign an affidavit that there was no false name used when arrested or
convicted. The Felon should sign a statement there was no fraud upon the
court. The responsibility is on the felon to fix any false records at the
felon's expense. 2 years grace period to fix the false record. No
grand-fathering of use of false name. Not grand-fathered in for lying to
the police or the court.
As for § 901.36 - Prohibition against giving false name or false
identification by person arrested or lawfully detained; penalties; court
orders Florida Statute 901.36 was created in 1999. This means that cases
prior to 1999, where a false name was used in conviction and incarceration,
many received clemency without fixing those false records. Someone
convicted prior to 1999 doesn't have the incentive to correct a record he
falsified.
