The problem with today's criminal justice system, is that the blame always gets pinned on a party during a criminal involved situation. This is why I am going into law school, because it helps you outsmart the system by knowing your rights.I would have told the judge AND the jury that I was using "self defense", and I got jumped by the gang. In the United States, you are allowed to use self defense. It doesn't matter if you get charged for fighting in public, they will typically drop it if you use this defense. The whole "fighting in public" bullshit charge is to keep the streets clean from people that just want to pick on people for no reason. This is why the country of Australia has bar fights all the time, and its because their system doesn't nit pick on this stuff.
Notice the judge also wanted to get some kind of "conviction" out of the deal--so he offered to toss the arrest if you performed "community service". He was "in" on the whole deal---the many delays were to set you up for the agreement. This is done here more often than not. One public defender verbally admonished you for wanting a jury trial--a recognized Constitutional right. If the trials are burdensome then they should stop the minor arrests. I personally know an attorney who is letting a man spend his ice behind bars for a sex crime he did not commit because the man cannot afford his prices. Pretty sorry individual I'd say. Re the arrest--it still is on your record as there is no such thing as an arrest being expunged--that only hides it form the eyes of the public but official agencies can still see it. You should have insisted on a trial--you would have been no worse off!
+JoshCube2 the first day I went to court I requested for a public defender. I was being charged for disorderly conduct. But keep in mind public defenders usually are overwhelmed with cases. So they do not hold the same bearing as if I had the money for a private lawyer. The five times I went to court i must have talked to three different public defenders of the day alongside each time there was a different DA. None of them even read my case until my name was called. Each time I arrive at 7 a.m. i waited in court for about five hours just for a public defender to talk to me for three minutes outside the court room asking if I wanted to plead guilty. Every time I said no I should not feel forced to plead guilty or pay any fines just for defending myself in return i would receive a pink slip stating to return back about a wek later each time. On the fourth time I went to court one public defender wanted to throw the case out but the DA for that morning said no. I came back for the fifth time a week later. This time I requested a jury trial. The public defender was mad at me as she mentioned she had more important cases to deal with. This is because courts feel jury trials for a low misdemeanor charge cost to much money and are time consuming. The public defender tried to intimidate me by mentioning that I can do six months of jail time if convicted guilty. I would not give in until I finally spoke to the judge. He actually gave me my dignity as he did acknowledge about how I was upset and disappointed over the cop who arrested me. He offered that if I do 40 hours of community service he would throw the case out with no misdemeanor conviction. So I agreed just because the amount of time that I was wasting showing up to court each week was wearing me out and time consuming as I had work and school to manage. The system is just confusing because I pleaded no contest to get the case dismissed agreeing to do community service. I felt that I should not have even done that and the case should have been dropped the first day I went to court. I understand why public defenders are called public pretenders. But keep on mind often times people plead guilty over crimes they did not commit because they want to just get the case over with or do not have the time and resources to deal with the court system. Just because you are provided with a public defender dosnt mean everything will be okay. If my job did not allow me to take one day out of the week for the next five to spend in a court room I would have had no choice but to plead guilty and pay fines for a charge that I did not commit.
The current standard for detention is--1. The person IS committing a crime. 2. The person is ABOUT to commit a crime. 3. The person has committed a crime in the past and that crime is known to the officer. There is NO provision for detention under any other circumstance. "Suspicion" is not a cause for detention--see Brown v Texas.
People are arrested because they are suspected of committing an offence worthy of arrest.What I will say is if someone needs to be brought in, the cops should first allow them to come peacefully, no cuffs, not yelling, just "You're suspected of a hit and run, would you please come with us to the station so we can sort this out."

It is interesting comment. In Louisiana a citizen may make an arrest for a felony ONLY-committed in or out of the citizen's presence. The procedure is to tell them the same thing the police would-"You are under arrest". If they submit--then the citizen must turn the arrestee over to the nearest police officer and he or another officer is required to help you fill out the paper work. I've yet to talk to an officer who has had this happen. Should an officer try to arrest someone illegally it is only a misdemeanor. However--any illegal detention of one citizen by another while the one doing the detaining is armed--is a felony. So one could arrest and officer who is performing an illegal arrest. It would be a good idea to study case law in your state to see how the courts have viewed this before trying for real.
+Z200a Its the same as your rights afforded under citizen's arrest but the biggest problems are (1) a non-police person doesn't have immunity so even though they can exercise this right they have to be willing to go to jail to do it. They have to also call the police when it happens which is why it is so important that this be done collectively because they'll show up and shoot you! They'll always side with their own if you're all alone...you have to ask that a supervisor come to the scene and even if other officers show up you have to release him into their custody which is really nothing at all because they'll turn around and arrest you for assault on a officer, obstruction for keeping them from arresting somebody else along with a bunch of other things. You have to do it collectively or get yourself on tape....I've seen it done...it works to a point, it's not perfect but you can definitely detain an officer if they're doing way way too much or if they're being unlawful...you just have to be able to prove it and you need community support because they'll kill you.
There are laws in place to deal with this type of thing but it is expensive, time consuming, and emotionally draining. The system is counting on you not having the time or money do mount an effective defense. You can file a civil rights suit yourself by downloading the forms off the net, paying a filing fee, and then simply showing up in court (federal). To prevail you must show two things--1. Your rights were violated 2. It was done under color of law. If case law is well established in your favor then the issue is cut and dried--again in your favor. See St. John vs McColley as an example of how to pursue your own civil rights case.
+Robert Watson It's bureaucracy because the law enforcement agencies have full discretionary rights on everything and the same agency that enforces also reviews it's own practices to see if they're lawful...everything happens through law enforcement during the investigatory phases. If you want to prosecute a cop the office will tell you to first file a complaint with the police department. Even the city's council can't directly do anything without first waiting for good old internal affairs. There are no real non-police counterpart with internal affairs who have knowledge on the law and police procedure to ask the questions we as citizens want to ask and review practices. There is no representation for non-police at the investigatory level after a officer incident....It takes a lot to charge cops with anything unless the people collectively address every situation and I do mean COLLECTIVELY...try visiting the police department 60 or 70 strong or going down to the court's clerk office 70 strong asking for forms to file a complaint against a officer...nobody does that...they just march which is good for attention but what next?
The Supreme Court has said (more than once) that ALL warrantless entries are presumptively illegal and in such a case the entry is not looked at favorably. The authorities must justify their actions.

Officers are not stating what the charges are in a timely fashion because they're making their case as they go along. Everything starts with a allegation they can either prove or not prove...they show up and interview you to determine your credibility and somewhere along the line if they detect things aren't adding up they become "interested in you." The time between them becoming interested in you and actually making a formal arrest is taking way longer than 15 min...sometimes longer than 20 min. You can't tell when the actual detention started...its supposed to start when you don't feel free to leave but isn't that the same as arrest! So if you won't let me leave but you have no reason to talk to me you certainly will find a reason by the time our conversation is up and you will arrest me for something even as petty as "resisting" or "obstruction" when in the beginning you had no reason to talk to me in the first place other than your "interest." I'm being sarcastic but that's generally the play book, yep yep.
There's a big difference between false arrest (or "unlawful arrest") and an innocent person being detained. Warrants are issued for innocent people all the time, and then of course there's probably cause. In this case a bruised child's complaint gives them that, even if it was a lie. She was resisting a legitimate detainment, they overdid it by dragging her out of her apartment and all that, but now (If it's true, if she really wasn't opening the door and fighting the officers) she doesn't have a case against the PD. If that ever happens to you, just go and demand your lawyer right away. Right away. Don't let them talk you out of it, they'll say they'll try. I can't stress that enough. Even if they do charge you pre-emptively, charges can be dropped in a second. Until you're arraigned, nothing's on your record.. Not even an arrest. Be smart, *call* your lawyer, don't try to fight the cops.

a public pretender is funny they work for the county and office is just down hall from DA and yes they do have to read your right I have family who worked in lawyer's offices, court house and my great uncle was an officer and my grandpa was a deputy for short time and he talks crap about police all the time I have been questioned before for no reason in ky I wasn't charged with anything even though I was being a smart ass officer swore he got call about fighting neighbors told me he stood at my door listening for 20 minutes when he did knock I did not let him in but told him I would come out and speak to him he told me to turn around so he could check me for bruises I complied but laughed at him and told him I was more aggressive than my hubby he said I was too small to be like that I then told him we were watching a movie and only let him look in the house to see my hubby and children sitting next to my spot with my blanky in it and that's just one time the same officer bothered us till we moved back to my home town my hubby thinks he had other intentions and actually asked him one day who he was trying to sleep with him or me lol neither of us was ever charged though when he would show up but I think officers should be drug tested and psychiatric evaluation on regular basis too many get on power trips or having a bad day and take it out on others and of course I have had some great officers really be there when we needed like last month when my dope headed sister took off with two kids she has no rights to and they searched all night long kept me updated had me call them if I found out anything they even tried to help calm me down and in the end the twins were safe at home and no I didn't press the charges I told my sister I would never again try to help her get clean and took her to her friends house and haven't looked back
They wouldn't know a suspect is innocent. Otherwise they wouldn't be arresting them. Most "resisting" charges do get dropped if the other charges get dropped unless the cop's a douche or you were a douche and provoked the douche. A much better strategy is to stay calm, and get your lawyer right away. When the lawyer comes in the interrogation room it's like the cops are back in 5th grade and the bell just rang. Not only will he destroy the state's case on police misconduct of some sort, but he could ruin the cop's career. In fact if I were a defense attorney (Generally they make less money, unless you're the defense attorney to the elite, doing a lot of white collar crimes) I would love to witness a cop assaulting my client, cause I'm filing a civil suit the second the courthouse opens. Those police brutality cases settle for a nice amount of cash, and the lawyer takes home at least 20%, and the state winds up paying for the cops actions but the cop loses his job and pension.However, those lawsuits are very hard to win if it's just your word against or if it looks like you provoked it. Go quietly and call your lawyer, it's his job to make the police uncomfortable and get you compensated for any damages.

You're supposed to have the right to resist unlawful police arrest...the only problem is you have to do it collectively for it to be effective. One person doing it just gets him or her in trouble...30 people doing it just means they have to call SRT in which requires approval from higher. Higher will ask "how is it you went to one persons house on a call and we ended up with SRT for the whole unit. That's when supervisors and such start using their heads and throwing their own under the bus to protect their jobs because they know people aren't going to stand for it. Everybody has to be committed to stopping the police action..you can't have squeamish people saying "I don't wan to get involved."
Once you are under arrest--you MUST be advised of your rights. This may be sooner or later--but this will have to take place for any information obtained (during questioning) to be used in court against you. The exception is if you voluntarily and KNOWINGLY waive your rights.

I've never understood how someone could have resisting arrest as the only charge. In order to resist arrest you must be under arrest. If there isn't another charge then you couldn't have been under arrest and thus could not resist the arrest.

Unfortunately in America you have to trust police, that is just how our system works. Unless you think we should have no cops then you can't really disagree with that. If you break out of a cop's car or assault them while in handcuffs you are breaking the SYSTEM, not the cop. So in summation the system is at the root of your "problem", not the cops. Why? Unless during the arrest they are hurting you when you aren't resisting arrest there is no point to resisting arrest. Especially when you are highly outnumbered and outweaponed.
Dam right. I got arrested after a got jumped by some thugs. After I didvm everything to defend myself I was knocked unconscious. The guys who beat me took off when the cops showed up. As I got back to conscious one of the pigs started yelling at me to walk back to the direction in which the guys who jumped me ran off to. I explained to the officer that going back to thatcm street wasn't safe and can I just walk to the hospital. He then slammed the cuffs on me, did not read me my rights and arrested me. I never Been arrested in my life and do my best to be a good citizen. To make things worse I spent the night and day in jail on the hard floor with that dirty ass bkanket as I was in so much pain after getting jumped earlier. After getting released I was charged for a misdemeanor and had to go to court. I couldn't afford a lawyer so I had to show up to court five different times just to get the case thrown out after I agreed to do community service. Only becausecshowing up to court every week was wearing me out and I was loosing money from work. I hated the fact that i did nothing wrong to be arrested and still had to deal with the system. Thanks Long Beach PD for making my spring of 2012 miserable.

I didn't say they did. I responded to the person that said they needed a warrant or reasonable suspicion. There's other reasons that gives an officer the right to go in... like I said exigent circumstances.

They can't search closed closets, open cabinets ect.. They can (and do) check for signs of a struggle or obvious signs some sort of altercation has taken place.
