+Vanessa Cruz Photography LLC Really? Are you wanting to be a OTR driver or just stay local? Good luck trying to do both. It's tough cause truckers work a lot of hours. But you can do it. I live on the border of KY and IN, so those sales tax questions are tough, as I shoot in both states. Thanks for watching. :)
Great video, I have been working on providing these answers to
photographers because it can get really confusing. I am a tax attorney
specializing in sales tax and I have also worked as a professional
photographer. I am working on doing a new video shortly and will work on
giving general answers to some of your questions. My website has a lot of
information on sales tax issues photographers deal with and a comprehensive
guide. I am going to shoot you a message about my guide, and maybe you can
add the link to your video or let folks know about it.
I am not an attorney and can not offer legal advice. I can only offer
opinions and ask questions.
If you did not charge tax to those customers out of state but you paid it,
would the amount of tax you paid, but did not collect be an amount that is
worth the extra accounting costs of keeping more detailed records?
The sales tax calculation of (retail product sold * tax rate = the amount
of tax you pay state) is much easier than keeping a list of those who
rightfully or wrongfully said I don't live in the state and do not want to
pay that tax.
If it is less than $100.00 a year, it may be worth just giving the state
the money even though you did not collect it. In other words pay the tax
for the customer to keep everybody happy and it turns into a discount,
which is discounted against the company's income.
Laws are different from state to state but in California it is legal to pay
sales tax above what was actually collected. They only want their money
they don't really care if the customer gave it to the business or not.
Indiana? You're so close I'm in Chicago. I thought you lived in
Missouri...I haven't been shooting for a great while. Best thing is ask
your the person you do your taxes with. Hugs, Zoe
+Crafting Pantry (AF0093) Thanks Zoe. I'm about 5 hrs, I think from Chicago. I'm right on the IN/KY boarder. What made you think MO? I never said that. lol. Thanks for your comment.
I know what I need to do. I just want to hear how others file their taxes in that situation. Professional advice is always advised. The comments are coming up exactly as I thought they would. All over the place. Thank you for commenting.
To be on the safe side of things with the right information. l'd call your
State Board of Equalization. Off the top of my head l'd say yes! But give
them a call they can and will answer that for you correctly.
Wow! Never knew you were a Hoosier too! I live in Indianapolis and want to
be a photographer as well. I've been a subscriber for some time and don't
recall you ever saying you lived here. If you ever decide to do a photo
walk or something let me know.
+slimdoja357 I usually say I'm from Louisville, since I am in the metro area in southern Indiana. I have videos of my by the Yum center a few times, I guess you missed the connection. I been in this area for about 12 years. I am a New Yorker at heart. Born and raised there.
I don't charge any sales tax, but heres something you might not know, you
will get a refund for all the gas money you spent going back and forth to
shoots, they will pay for your camera and all kinds of stuff. I'm not sure
how all it works as I haven't done it with photography yet, but I used to
work with the police and it was a small town. I had to buy my own gun,
handcuffs, belt, bullets, etc. I submitted the receipts and they paid for
all of it. I was told I could do the same thing with photography.
You must be talking about tax deductions. Everything related to my business for the most part is tax deductible, which lowers the amount of taxes I pay on income.
It has something to do with if you need something for work, it comes back in your taxes. Like I said I couldn't be police without a gun, so I turned in the receipt and when the taxes came in, they paid for the gun. From my understanding it's the same thing with photography if you are an LLC. To be an LLC small business doesn't cost much. I became an LLC with 30 thousand dollars worth of photography insurance, incase something breaks or is stolen, as well as being sued for up to 2 million dollars for 30 dollars a month with State farm.
