The compelling reasons for the officer's physical attack on the elderly man
seems arguably to be self defense, BUT ... the fact that he tampered with
the recording, or the recording device(s), could suggest otherwise. To end
this type of ambiguous and/or prejudicial evidence, all officers must be
made to regard ALL audio and video recordings as sacrosanct. To achieve
this, if any recording device is turned off, or any recording tampered
with, the officer should be dismissed summarily. If the officer claims the
device "malfunctioned," s/he should be placed on unpaid leave while the
device is inspected by an independent third party for functional defect. In
the event the recording device(s) are found defective, the officer should
be reinstated with full back pay. In ANY case, the lack of recorded
evidence, in whole or part, should AUTOMATICALLY, AS A MATTER OF LAW, be
grounds for finding against the police in ANY legal action, civil or
criminal. That'd put a screeching halt to this kind of crap, once and for
all.
The video clearly stated that the police were called because a man pulled a
knife on another man about a money dispute. So now the cop arrives on
scene...here comes a man fitting the description of the subject that had
the knife, walking quickly toward the officer...the officer didn't know if
the man had a knife or not...if the officer let's the subject walk up on
him and the man is armed with a knife...he could get hurt or killed. I
believe any cop would have subdued this man in the best way they could. At
least the officer didn't draw his weapon. And I would really like to know
if the subject actually has dementia. I think it may be a ploy to try to
sue the department.
