well turns out there was a bracket broken on the thrust bearing/throw out
bearing that holds the fork in place but my gearbox is knackered also so
not good news for me :(

I had this on an '04 wrx. The shop that installed it said it was a
nightmare because it would keep falling off etc.
It's a known defect and only really affects ACT for some reason. I mean I
bought a kit from them sealed in '12, so I'd just avoid them... You'll save
money on the product but spend double on install. Or if you do it yourself
like I have in the past you'll just pull out your hair instead.
You may want to buy everything else from them and get another brands
pressure plate with the same rating.
My clutch was actually a Brute Power purchased from O'rielly Auto Parts, and had the same prob. Im going to weld it to the pressure plate to make sure it dosnt let go again!
I just took my car to the dealer today. I simply described what it was
doing and subaru of Plano replaced the throw out bearing. Problem is, he
said it would go out again in about another 10k. So every 10k I have to
drop my car off for a day or so? What happens when the warranty expires?

+MarcusDrall it required lubrication on the various contact points of the clutch fork and I also replaced the throwout bearing with a new stock throwout bearing... the difference was night and day... hope that helps. My buddy, who is a mechanic and had done one previous WRX transmission, knocked out the process in 4 hours from start to finish on a lift.
