The reason these are still banned, is that not enough people here in the USA even know what these are; how can people fight to make them legal, if they don't even know they exist? That's the problem.

And to the best of my knowledge, there has not been any choking issues anywhere in the world. Since the toys are not loose inside of the chocolate egg (the toy is in a plastic capsule), the makers of chocolate surprise eggs have ensured that even if "kids would shove them into their mouths right away" they would be stopped by that plastic capsule. The same law that makes these illegal, also stops people from placing a toy inside a giant chocolate Easter bunny. These are not legal in the USA for two main reasons.1. A 1938 law bans non-food items being placed inside chocolate candies (but it's still ok in other food items, so choking is not the reason).2. Most people in the USA have never heard of these, and therefore there is not a big drive to make them legal here, nor is there the knowledge of what they actually are, and how the toy actually sits inside the chocolate shell.

actually it has more to do with that law than being a choking hazard.since the capsules are much to large to be a real choking hazard.

there's a law saying no candy/baked goods can have a toy/trinket inside them.but if kinder simply didn't completely seal the eggs they'd be legal.

In italy they're legal, but they don't sell them in summer :(

Choking hazard and you can go to jail for that because they said you cant sell Kinder Eggs here but you can have them if you know about the choking hazard and if you're supervised by an adult or if you are an adult
