That is a PERMIT fee. It's for PERMISSION to use a space. That's why it's called a PERMIT and not a LICENSE.This video is about a LICENSE. Your example makes no sense, because nobody is forcing Ozzy to take a test to get a "Singing License". They are, in fact, making tour guides take a test to get a "Tour Guide License".Again, if this standard were applied to Ozzy, he would never be able to perform anywhere ever again. Ozzy can barely stand upright and speak coherent words, let alone have the mental wherewithal to pass a 100 question multiple-choice test on the fundamentals and history of music. 

No , I am claiming that Ozzy had to give some "public official" a wad of money to be able to perform in public , which you say doesn't happen.  I agree that it is strange they would License a tour guide but how else are "they" supposed to ensure the "official" version of history is advertised to tourists ?  Do you really think the gov wants a confederate giving tours of Shermans March ? Why would you need a license to charge people to listen to you talk about the city you live in? Can you imagine how idiotic it would be to have to prove to the government that you are a good singer before you can perform and make money off your songs? Having to fill out a form and take a test to make sure you know the government-approved type of lyrics you will be expected to know... it's absurd. And it's absurd in any type of profession where speaking is involved.

+Slip Lover Why should you need a license for that? The driver already has to have a driver's license for that type of vehicle. The vehicle already has to be licensed. Why should somebody need to get a THIRD license just to talk while in a vehicle? It makes no sense.

Agreed. License requirements are just a way for government to have even more control. For instance, why do we need a license to get married? I've never heard a respectable answer to that question.

Are you a United States citizen? Do you work within the United States with no direct dealings with any foreign entities? Then you don't owe any federal income taxes (500 wordshort answer...) under the constitution. Heck, the 16th amendment was not even ratified by enough states to actually become law in the first place. So even if you want to argue that the 16th amendment some how somewhere does make you liable (which it does not), and actually wanted to follow the law the 16th is not relevant.

So you're saying that if I don't do a perfect job when I prepare tax returns for my family and friends for a small fee I should be blackmailed, kidnapped, and/or shot and killed? The testing takes time and money, things most people don't have in abundance. But regardless of how difficult it is to get a license, the fact that you think that people should be subjected to violence if they don't get one is ridiculous.

@krugcpa: Mr. Kilian has applied for an economic hardship waiver from the E-file requirement. He is 80 years old, does not own a computer, and doesn't know how to use one. It makes little sense to require him to try to do so at this point - gentlemen like him are the reason for a "grandfather clause." As for his prices, they may be way below market wherever you are, but he lives in the rural village of Eagle, WI. And he is entitled to set his own prices at whatever level he feels is fair.

@wickedeagans Are you trying to say that they don't have to pay b/c your state made an amendment to your state constitution. b/c if so that's absolutely not true. federal constitution trumps state constitutions, and to go even further, a state constitution can be ruled unconstitutional if not in compliance with our countries constitution. Tax preparers who are not EAs, CPAs or attorneys are, most likely, the only professionals who are NOT licensed. Even hair stylists, etc. are licensed. The testing is not that expensive & the continuing education should have always been required. We do a major disservice to our clients by not being on top of the latest laws and regulations. I plan on taking the exam after April 17. I am 68 years old and have been preparing tax returns for many years. Time to weed out the bad preparers!

No, bad preparers continue to create additional taxes for people in the form of penalties and interest because they stay in business. The IRS closes very few places. Where I am, there are three businesses who do terrible tax prep work. I know because I fix what they mess up. The consumer/tax payer is the real victim here. But I agree that if all doctors have to have licenses, then all tax preparers should. The fact that H&R Block doesn't have licenses preparers is a clue, folks.

If the three people who sued the IRS put that much energy into passing the exam, they would have had several hours left over. The test is basic competency. If you cannot pass this test, you have no business preparing taxes.. You do not have to spend hundreds of dollars on classes as this is basic stuff. I would think that the general public would rather hire a tax preparer who is licensed that someone who does not keep up with the tax laws and cannot pass a basic test.

The income tax is slavery, and creates tyranny over citizens. It's done nothing but give us an overbearing, war mongering, debt ridden government since 1913. The same year the private Federal Reserve was created. All our taxes basically got to them in the form of interest. Our government is corporatist, and they will drive small business into the ground leaving only the mega corporations as our only choice. Then they can get away with jacking up prices.

CPAs have to take an exam, Lawyers need to pass the bar, Doctors have to go through med school. WHY would 1 test to ensure that people who claim to know what they are doing be so bad?

@rb5589 dude really what did you not get about this??? here ill make it easier for you to get man...1st off- its unconstitutional for any state to take any tax out of your income it was wrote in the Constitution that way and the gov tried to change it and they had to take a vote on it and guess what voter fraud pretty much... not as many states voted for the amendment to be changed go read this and other sites like it talking about it

It isn't noted here whether or not H&R Block and Jackson Hewitt are contributing to the DNC and\or are Obama supporters, but it wouldn't surprise me Either way, taxes on all those that do pay them are necessarily going to increase under the present WH administration; and of course, if this scheme is allowed, it will destroy even more jobs, just as many of Obama's policies and actions are doing ala the Cloward\Piven theory

Good for you. You can advertise that then and you might get more clients. But it is quite immoral to force someone else to do this simply because you think it is best. They are't harming you. if I know someone who is great at tax returns, I don't want them to have to be bothered with taking and paying for a useless test. If I want this individual to prepare my taxes, the government has no right to say otherwise.

It's the responsibility of taxpayers to check references and understand the experience of the people they do business with. In this day and age it is easier than ever. Go in blind with the cheapest preparer in town that lives under a bridge? You'll get burned but that's not the system's problem. Licensing schemes protect big players period. Comparing tax preparing to practicing medicine is a real stretch.

@rb5589 i looked it up man... many states (including mine) did get there amendement to the 16th ademdment. cause the first one states that fed cant take tax from source of income, then all state made a amendment to the 16th stating that can tax fed and state out and like many didnt get it passed (ratified) so yes its unconstitutional Ron Paul 2012, thats why he wants to get rid of it, its unconstitutional

If there are dirty/bad shops, word gets out and they quickly go out of business or reform their practices. The free market will ALWAYS be far more efficient than any government regulation, no matter how well-intentioned.

I do agree I am the biggest fan of how the income tax is currently done, and will state what the IRS is doing here to prop up big business and close small competitors angers me greatly. But the one change I want to make to you is that the income tax isn't unconstitutional. 16th Amendment...
